港口拥挤和潮水情况造成无法靠泊-NOR能否在等泊锚地有效递交

英国商事法庭案例,合同规定NOR在港口拥挤的情况下可以在惯常等泊地点递交,但是实际情况是船舶由于港口拥挤以及潮水情况无法靠泊。英国商事法庭判定NOR能够在锚地有效递交,只要泊位拥挤造成无法靠泊。

By a contract of sale dated 1 December 2009 the claimant seller agreed to sell to the defendant buyer 390,000 mts +/− 10 per cent at the seller’s option of unclean coal in six shipments across the four quarters of 2010 on a cif basis. Clause 7.13 of the
sale contract provided:

'7.13 Upon arrival at the Discharge Berth the Master of the Carrying Vessel shall give a Notice of Readiness to discharge at any time during the day or night SSHINC whether in Free Pratique or not, and whether customs cleared or not, by telex, radio or e-mail.…In case the berth is occupied on arrival, vessel can tender NOR at the usual waiting place…whether in berth or not, whether in port or not, whether in free pratique or not, whether customs cleared or not.'

One of the shipments was carried in the vessel Hang Ta. When the Hang Ta arrived at the discharge port, the berth at which the vessel was to discharge was occupied by another vessel, and Hang Ta was therefore unable to reach the berth. The master gave notice of readiness (NOR) at the usual waiting place. It was common ground that the vessel was prevented from entering the berth both by virtue of the unavailability of the berth and also by virtue of the tidal conditions.

The buyer said that the seller was not entitled to give NOR at the usual waiting place. The seller said that since the berth was occupied on arrival the last sentence of clause 7.13 applied, entitling the master to give NOR at the usual waiting place.

————Held by QBD (Comm Ct) (Burton J) that the NOR had been validly given pursuant to the last sentence of clause 7.13. The unavailability of the berth entitled the vessel to give NOR at the usual waiting place notwithstanding the presence of tidal conditions also preventing access to the berth ;
