伊春空难机长被提起公诉一案引发人们对重大飞行事故罪的关注和研究.中国刑法规定的重大飞行事故罪立法本身存在诸多问题:罪名设定不妥帖,无法清晰表明本罪只适用于空勤人员违反规章制度导致的责任事故;罪状表述不严密,'发生重大飞行事故'与'造成严重后果'的关系不明确,且缺乏对'重大飞行事故'的解释;罪行适用范围有限,仅限于飞机发生的重大飞行事故,而排除了其他航空器飞行事故的适用,以及法定刑规定混淆的问题.建议将罪名修改为'重大飞行责任事故罪',严密罪状表述,以'航空器'替代'飞机',扩大本罪适用范围,并修改法定刑规定以完善重大飞行事故罪,促进航空安全发展. |

Summary:
The captain in YICHUN air crash was
publicly indicted attracting the attention to and study of the
Grave Flight Accident Crime. Grace Flight Accident Crime has some
legislative problems. The crime name is not appropriate,which
cannot clearly show that this crime is only applicable to the
airmen in violation of the rules and regulations leading to
accidents. The crime description is not accurate,while the
relationship between the'grave flight accident'and'serious
consequences'is not clear,and lacks the interpretation. The scope
of the crime is limited,which is limited to the plane excluding
other aircrafts,and the legal punishment regulations is confusing.
This study made suggestions accordingly to amend the crime name by
replacing'plane' with 'aircraft',expand the crime scope,and modify
the legal punishment rules in order to improve the terms of the
Grave Flight Accident Crime,and promote the development of China's
aviation safety.
