在美国法庭里使用手机电脑等其他电子设备的规定

前几天承蒙庄志明律师问询美国法庭里是否可以使用手机照相机等电子设备，我当时没敢匆忙回答，不仅因为我当时没时间查阅，而且我知道美国和中国一样地方很大，联邦和州法院的规定可能各异。

今天我特意查了一下，果然各级法院的规定各异，一般而言越是高级的法院限制就越严。


下面让我们从美国最高法院（Supreme Court of the United States）开始，下文来自于最高法院的网页【脚注1】：
“You will go through a security checkpoint as you enter the building and again as you enter the Courtroom. Weapons or other dangerous or illegal items are not allowed on the grounds or in the building. Please refrain from taking the following items into the Courtroom when Court is in session: cameras, radios, pagers, tape players, cell phones, tape recorders, other electronic equipment, hats, overcoats, magazines and books, briefcases and luggage. Sunglasses, identification tags (other than military), display buttons and inappropriate clothing may not be worn.”
你进入最高法院大楼和进入法庭要经过两次安检。武器和其他危险和不合法的物品不得带入大楼。也请不要在开庭时间带入以下物品：照相机，收音机，寻呼机，手机，录音机，其他电子设备，帽子，大衣，杂志，
书本，手提箱和行李箱。不准带墨镜，除军事标识，标识纪念章和不合适的衣着也不被允许。


这是最高法院，我们来看看号称联邦第二重要的法院华盛顿联邦上诉法院（U.S. Court of Appeals - D.C. Circuit ），同样的来自于华盛顿联邦上诉法院的网页【脚注2】：
“Visitors may keep an electronic device (e.g., cell phone, laptop, iPhone, iPod, MP3 player, etc.) in the courthouse and annex if the device does not have a camera (still or video) or is not capable of recording audio.”
访问者可以带电子设备（如手机，笔记本电脑，iPod，MP3唱机等等，不错，恩。。。）进入法庭和法庭附近，只要电子设备没有摄像头和录音功能。（这个规定是什么时候定的？？？！！！如今到哪里去找个没摄像头的手机？）
“All other visitors must check their electronic devices with cameras or recording capabilities at the entrances unless authorized in advance and in writing by a judge or court unit executive.”
除非有法官或者法庭行政管理人员书面批准，所以的访问者必须在入口交出带有摄像头或者录音功能的电子设备。
“All electronic devices must be turned off before entering a courtroom.”
所有的电子设备进入法庭之前必须被关闭。


以上是联邦法庭，那各个州的法庭呢？显然我不可能把50个州都研究一边，我随手搜索了一些，给大家几个州的例子吧，这样大家也能有点概念。
比如说马里兰州：
“Except with the express permission of the presiding judge or as otherwise permitted by this Rule, Rule 16-109, Rule 16-405, or Rule 16-504, all electronic devices inside a courtroom shall remain off and no electronic device may be used to receive, transmit, or record sound, visual images, data, or other information.”
除非法官特别允许或者三条规则允许，所以带入法庭的电子设备应关机，不允许任何电子设备用来接收，传送，记录声音，图像，数据和其他信息。


如果违反这些规则会怎么样？有报道（http://www.andrewflusche.com/blog/beware-of-cell-phones-in-court/）说一个佛罗里达妇女在法庭使用手机被控藐视法庭罪（Contempt of Court），虽经上诉脱罪，但是你想试试么？


总结：美国各个法庭的规定而已，最高法院的规定最严基本上不可能带入任何电子设备。联邦上诉法院的规定最搞笑，如今有多少手机和笔记本不带摄像头？各个州法庭似乎规定各异，但是在法庭内使用手机或者笔记本似乎还是要小心。


因为最高法院不得带入手机照相机，所以美国媒体报道的时候只能用素描画，下面是去年著名的医疗健保案的辩论第二天的情景。
