Party A is the employer of the project of photovoltaic power plant installation and Party B is the contractor of the project. Party A entrusts Party B with the construction of this contract project. For purpose of clarification of the rights and obligations of the parties hereto and to ensure construction safety, the parties enter into this construction contract for strict implementation by the parties:
4.1项目进度计划
4.1.1承包人提交项目进度计划的份数和时间：纸质版7份，电子版1份，合同签订后10日内提交给发包人。
4.1 Progress Schedule of Project
4.1.1 Copies number and time for the Contractor to submit the Project Progress Schedule: 7 paper copies and 1 electronic copy to be submitted to the Employer within 10 days upon conclusion of the contract.
4.1.2承包人在项目开工后，每周星期四16:00和每月25日之前按时将编制好的工程周报、工程月报传给发包人。编制内容包括本周、月施工安全、质量、进度情况，以及下周、月施工计划和各项施工安全、技术等措施。
4.1.2 The Contractor shall, subsequent to the commencement of the project, transmit the reports of prepared weekly and monthly construction to the Employer on time at 16:00 on Thursdays and before the 25th of each month, which includes the construction safety, quality and progress of the week and month, in addition to the construction schedule for the next week and month, and measures of various construction safety and technical.
4.3物资采购与进度计划
4.3.1工程物资采购及开始日期的约定：1）物资采购规格、型号、数量以设计院提供的设备清单；2）日期按工程进度计划确定。
4.3 Material Procurement and Progress Schedule
4.3.1 Agreements on procurement of materials for the project and the commencement date: 1) Specifications, models and quantities of materials to be procured are based on the list of equipment provided by the design institute; 2) Date to be determined in accordance with the progress schedule of the project.
5.1生产工艺技术
5.1.1承包人提供的生产工艺技术、工程试运行考核保证值和使用功能的主要技术指标参照《光伏发电站施工质量检查及验收规程》、《光伏发电站设计规范》、《光伏发电工程验收规范》、《钢结构工程施工质量验收规范》和国家和行业颁布的相关技术标准。
5.1 Production process technology
5.1.1 The main technical indexes of the production process technology, engineering test run assessment guarantee value and use function provided by the Contractor refer to the Regulations for Quality Inspection and Acceptance of Construction of Photovoltaic Power Station, Design Code for Photovoltaic Power Station, Acceptance Code for Photovoltaic Power Generation Project, Acceptance Code for Quality of Construction of Steel Structure Project and the relevant technical standards promulgated by the state and the industry.
5.2.1发包人的义务
（1）提供项目基础资料。
发包人提供的项目基础资料的类别、内容、份数和时间：发包人应在合同签订后根据实际情况提供设计所需的项目测绘资料、地勘资料、电网接入系统报告及项目的规划报告、可研报告、项目备案文件、项目用地的边界红线图等所需的其他文件。
5.2.1 Employer’s obligations
(1) Provision of Project Basis Information.
Type, content, copies number and time of project basic information provided by the employer: The employer shall provide project mapping information, ground survey information, grid access system report and other required documents such as planning report, feasibility study report, project filing documents, boundary red line map of the project site and other required documents for the design subject to the actual situation upon conclusion of the contract.
（3）除电网接入系统报告及批复、项目的规划报告、可研报告、项目备案文件的费用由发包人承担外，其他费用均由承包人承担。
(3) All other costs shall be borne by the Contractor except for the costs of the report / approval of the grid access system, the project's planning report, the feasibility study report and the project's filing documents, which shall be borne by the employer.
5.2.2承包人的义务
经合同双方商定，发包人委托承包人提供的项目基础资料、现场障碍资料的如下部分，可按本款中约定的如下时间期限，提出进一步要求。
5.2.2 Contractor’s obligations
As agreed between the contracting parties, the following parts of the project base information and site obstacle information submitted to the Contractor by the Employer may be subject to further requests in accordance with the following time periods agreed in this paragraph.
第9条 工程接收
Article 9 Receipt of Works
设备、系统安装调试完毕，承包方自验合格后，在认为已具备验收的条件下书面提出验收申请，并附验收内容、验收时间和完备的竣工资料，承包人负责组织调试、运行等单位参加安装结束后的静态系统检查验收。
The contractor shall, upon passing self-inspection subsequent to completion of the installation and commissioning of the equipment and system, submit a written application for acceptance accompanied with the acceptance content, acceptance time and complete completion data. The contractor shall be responsible for organizing the commissioning and operation units to participate in the static system inspection and acceptance of the installation.
9.1.2接收工程提交的资料
9.1.2 Information to be submitted for acceptance of works
提交竣工试验资料的类别、内容、份数和时间：7份，光盘一份，项目竣工验收后1个月内。
上述所有提交文件均需提供电子档一份（须为CAD、WORD、EXCEL等可修订格式）
Type, content, copies number of and time for submission of as-built test data: 7 copies, 1 copy on CD-ROM, within one month after project completion and acceptance.
All of the above submissions must be provided with an electronic file (must be CAD, WORD, EXCEL and other revisable formats)
第14条 履约保函
（1）承包人保证，在收到中标通知书的同时向发包人提交履约保证金。履约保证金为中标金额的百分之三（3%）。发包人将在工程接收证书颁发后28天内把履约担保退还给承包人。
Article 14 Performance bond
(1) The contractor undertakes to submit the performance bond to the employer upon receipt of the Notice of Award. The amount of performance bond shall be three per cent (3%) of the successful tender amount, which will be returned to the contractor within 28 days upon the issue of the Certificate of Acceptance of the Works.
（3）如工程延期，承包人有义务继续提供履约担保。由于发包人原因导致延期的，继续提供履约担保所需的费用由发包人承担；由于承包人原因导致延期的，继续提供履约担保所需费用由承包人承担。
(3) Where the work is extended, the Contractor is obliged to continue to provide the performance guarantee. 第16条 保险
16.1承包人的投保
