除专用合同条款另有约定外，发包人提供的工程量清单，应被认为是准确的和完整的。出现下列情形之一时，发
包人应予以修正，并相应调整合同价格：
Except otherwise stipulated in particular condition the bill of quantity which submitted by the employer should be deemed as accuracy and completion. Where any of following circumstances occur the employer should make correction thereof and effect corresponding adjustment of contract price.

（1）工程量清单存在缺项、漏项的；
Existence of absence or omission in Bill of Quantity;

（2）工程量清单偏差超出专用合同条款约定的工程量偏差范围的；
The deviation in Bill of Quantity exceed the same which are provided in the particular condition hereof.

工程量清单或其他报表中可能列出的任何工程量仅为估算的工程量，不得将其视为：
any quantities which may be set out in the Bill of Quantities or other Schedule are estimated quantities and are not to be taken as the actual and correct quantities:

承包人应于每周周六中午之前向工程师提交上周已完工程量的报告，承包人于每月的25日之前，向工程师提交上月已完工程量的报告。工程师接到报告后7天内按设计图纸核实已完工程量（以下称计量），并在计量前通知承包人，承包人为计量提供便利条件并派人参加。
The Contractor shall present to the Engineers a report with respect to the completed quantity of the Project for the last week before the noon of every Saturday, and the Contractor shall present to the Engineers a report with respect to the completed quantity of the Project for the last month before 25th of each month. The Engineers shall verify the quantity of the completed work according to the Drawings (hereinafter referred to as Quantity Verification) within 7 days after receipt of the report, and notify the Contractor before Quantity Verification; the Contractor shall provide convenience for Quantity Verification and assign staff to participate in Quantity Verification.

工程师收到承包人报告后7天内无任何正当理由未进行计量，承包人报告中开列的工程量即视为被确认。工程师不按约定时间通知承包人，致使承包人未能参加计量，计量结果无效。
If the Engineers fails to conduct the Quantity Verification within 7 days after receiving the Contractor’s report without any justified reason, the quantity listed in the report will be deemed as approved. The verification result will not come into effect if the Engineers does not notify the Contractor at the time as agreed upon which results in the Contractor’s failure of participating in Quantity Verification.

对承包人超出设计图纸范围工程量，工程师不予计量。该工程量由承包人自负后果。
The Engineers shall not verify the quantity of the work which is beyond the scope of the Drawings. The Contractor shall be responsible for the result of such quantity of work.

工程量表是指构成投标书一部分的已标价的以及完成的工程量表。
'Bill of Quantities' means the priced and completed bill of quantities forming of the Tender.

没有工程师的指示承包商不得作任何变更。当工程量的增加或减少不是 因按本条发出的指示所造成的，而是由于工程量超出或少于工程量表中所规定者， 则不必发出增加或减少工程量的指示。
The Contractor shall not make any such variation without an instruction of the Engineer. Provided that no instruction shall be required for increase or decrease in the quantify of any work where such increase or decrease is not the result of an instruction given under this Clause, but is the result of the quantities exceeding or being less than those stated in the Bill of Quantities.

工程量表中开列的工程量是该工程的估算工程量，它们不能作为承包商 履行本合同义务过程中应予完成的工程的实际和确切的工程量。
The quantities set out in the Bill of Quantities are the estimated quantities for the Works, and they are not to be taken as the actual and correct quantities of the Works to be executed by the Contractor in fulfillment of his obligations under the Contract.

无论工程量是否标明，投标者应对工程量表中的每项工程标明单价和总价。对单价和总价未标明的项目，在建设中业主不予以支付，其价格视作已包括在工程量表中其他的单价、总价中。
The tenderer shall fill in rates and amounts for all items of work described in the Bill of Quantities, whether quantities are stated or not. Items against which no rate or amount is entered by the tenderer will not be paid for by the Employer when executed and shall be deemed covered by the other rates and amounts entered in the Bill of Quantities.

承包人应于每周周六中午之前以及每月的25日之前，向工程师提交已完工程量的报告。工程师接到报告后7天内按设计图纸核实已完工程量（以下称计量），并在计量前通知承包人，承包人为计量提供便利条件并派人参加。
The contractor shall present to the engineer the quantity progress report each week before Saturday noon and before the 25th of each month. The engineer shall check it against the design drawings(hereinafter referred to as quantity checking) within 7 days after receipt of the report, and makes its observation to the contractor; the contractor shall appoint his staff to realize the quantity checking if necessary.

工程师收到承包人报告后7天内未进行计量，承包人报告中开列的工程量即视为被确认。工程师不按约定时间通知承包人，致使承包人未能参加计量，计量结果无效。
If the engineer does not carry out measure during 7 days after receiving the report, the quantity in the report will be deemed as approved. The project estimation result will not come into effect if the engineer does not inform the contractor of participating in estimation on time.

对承包人超出设计图纸范围工程量，工程师不予计量。该工程量由承包人自负。
The engineer will not check the quantities which are excluded form the contracted scope of the contractor and the cost will be born by the contractor.

承包单价与工程量计算方法
Contracting Unit Price and Calculate

±0.00及以下与屋面以上按 元/立方米计价结算，其工程量按施工图或设计变更计算，标准层按承包包干单价： 元/，以建筑面积结算；
±0.00 and below in addition to the roof above are settled accounts as Yuan / m3; the quantity hereof are calculated as per drawings or design alteration; standard floor referred to the contracting unit price, viz. Yuan / m3 on basis of construction area.

当工程量清单中有对应分部分项工程名称时，按该项目综合单价确定调整。
Where The name of sub-part or sub-item project is listed in Bill of Quantities, the comprehensive unit price of Bill of Quantities will be applied to such project.

当工程量清单中无对应但有参照分部分项工程名称时，参照工程量清单中类似项目综合单价确定调整。
Where although no corresponding name of project in Bill of Quantities, the name of other sub-part or sub-item project which may be made reference, the adjustment will be effected by reference of the comprehensive unit price of like item in Bill of Quantities.

结算工程数量确认
Quantity Confirmation for Settlement

以乙方实际施工完成的工程量和经过甲方技术负责人、监理工程师现场验收，并以建设单位计量的设计图纸计算数量为依据进行计量结算工程量。
The work quantity for settlement will be measured subject to party B’s actual completion and the site acceptance of party A’s technician in charge and supervision engineer in addition to the quantity which is calculated on the design drawings of the Owner.

工程量清单中的所有工作量都只是预设与暂定的.顾问工程师正在复核设计,他们的最终报告的工程量将作为本工程实施的依据.
All quantities in the Bill of Quantity contained herein are only indicative or provisional in the sense that there is an on-going review of the design by the consultant whose final report will be the basis for works execution.

工程量清单报价是指对工程量清单完成全部报价的文件,并作为报价文件组成部分
Bill of Quantities means the priced and completed Bill of Quantities forming part of the Bid.

承包总价：固定总价 美元，其中税金一项不含在总价中由甲方缴纳。除工程量变更签证外，总价不作调整。签订合同签乙方必须提供470万美元的工程量清单报价一份，作为合同附件。无预付款。
Contracted Price: Fixed price is US Dollars, among which taxes is not included and should be paid by party A, no any adjustment of fixed cost except to the written confirmation of quantity alteration. Party B should, on signature of contract, provide a copy of Quotation for Bill of Quantity which is valued as US Dollars 4.7 million as the appendix herewith. No prepayment.

按施工月进度付款，乙方于当月24日将每月完成工程量报送甲方审核，以业主审计的工程量为准；以乙方合同清单报价的项目单价计算工程价款，以完成的工程价款的60%进行支付。
Payment shall as per monthly progress of execution be effected, for which, party B should on 24th date of that month submit Bill of Completed Quantity to party A for review and approval and shall be subject to the quantity audited by employer and the unit price which is quoted in party B’s Quotation Bill herewith. Payment shall be made for 60% of the cost of completed quantity.

承包人每月25日向监理工程师提交已完工程量报告，由发包人和监理工程师对工程量报告予以审核确认。
Contractor will on 25th each month summit supervision engineer with Report of Complete Quantity which is for the examination and confirmation of employer and supervision engineer.

在该分包工程价格表中所列的工程量仅是估算数量，如果增减范围在±＿％之内，
则单价不作任何变化。
如果增减范围超过±＿％，应按总包合同一般条款中第＿条规定办理。
The quantity specified in Subproject Price List is only estimate, if, increase or decrease range within ± _%, no adjustment shall be made to unit price.
Provide that if increase or decrease range beyond ± _%, shall process as per Article in commercial condition of General Contract.

对于乙方擅自超出设计范围和因乙方原因造成返工、延误所增加的工程量，甲方不予考虑。
6.3.6 Party A shall not take into account the increase in the quantities done by Party B beyond the scope of design without authorization and the reworking and delay due to Party B’s reason.

工程量按经规划局和自来水公司批复的施工图纸计算，图纸外工程量按工程师的实际施工测量确认，材料及设备价格经甲方审定后予以结算，其他项目措施费、包干费、设计费不再另计。
The bill of quantities will be calculated subject to the construction drawings approved by the Planning Bureau and the water company, the bill of quantities beyond the drawings is confirmed by the engineer's actual construction measurements, the price of materials and equipment will be settled upon Party A's validation, and the cost of other items of measures, lump sums, and design fees will not be calculated separately.

在施工中如发生因甲方的原因所导致的工程量增加、变更等情况，乙方向甲方提交工程量签证单，甲方应在两日内在回执上给予认可或有关意见，否则，视为乙方签证单被甲方认可。
Provided that any increase or amendment occurs during the construction due to Party A's reasons, Party B shall render the Confirm List of the works to Party A which shall, within two days, give its approval or relevant opinions on the acknowledgement, otherwise shall be deemed Party B's Confirm List has been accepted by Party A.

在施工中如有因乙方的原因所产生的工程量增加、变更等情况，由乙方承担费用。
The costs of any increase or amendment in the work quantity in the construction due to Party B's reasons shall be undertaken by Party B.

承包人向工程师提交已完工程量报告的时间：当工程达到形象进度后7天内，承包人提交工程量报告和进度款申请表。工程师收到承包人的工程量报告和进度款申请表后按本合同约定进行确认。
The time for the Contractor to report to the Engineer: The Contractor shall, within seven days upon achievement of visual progress, submit the quantity report and application for progress payment and the Engineer shall upon receipt of the Contractor's quantity report and progress payment application form, make confirmation of the same as specified herein.

其工程量计算方法为：变更工程量为同一项目内容变更后的工程量（按图纸上标注的范围计算）减去变更前的工程量（按图纸上标注的范围计算）的差，正数时该项目工程量增加，负数时该项目工程量减少。
The calculation of quantity of work is that the quantity of varied work will be the difference by the quantity of varied work of the same project content (calculated according to the scope marked on the drawings) minus the quantity of work before the variation (calculated according to the scope marked on the drawings), with the positive number indicating an increase in the quantity of work for the project and the negative number indicating a decrease in the quantity of work for the project.
