工程试车Engineering Trial Run
试车程序Procedure of Trial Run
工程需要试车的，除专用合同条款另有约定外，试车内容应与承包人承包范围相一致，试车费用由承包人承担。工程试车应按如下程序进行：
Where the project needs the trial run or test, unless otherwise stated in particular condition, the contents of trial run shall be consistent with the same contracted by the contractor, the cost thereof will be born by the contractor, and the trial run procedure should be carried out as following:
（1）具备单机无负荷试车条件，承包人组织试车，并在试车前48小时书面通知监理人，通知中应载明试车内容、时间、地点。承包人准备试车记录，发包人根据承包人要求为试车提供必要条件。试车合格的，监理人在试车记录上签字。监理人在试车合格后不在试车记录上签字，自试车结束满24小时后视为监理人已经认可试车记录，承包人可继续施工或办理竣工验收手续。
The contractor shall, upon satisfaction of single machine unloaded commissioning, organize a trial run, and give the supervisor a 48 hours’ notice with trial contents, time and place thereof. The contractor prepares the trial record, the employer provide the necessary conditions for trial subject to the contractor’s requirement. Where the commissioning is qualified, the supervisor shall sign the record of the trial run, however provided that the supervisor refuse to sign the trial record upon the qualification of commissioning, the trial record may be on and from 24 hours subsequent to end of trial run, deemed as confirmed by the supervisor, and the contractor may continue to work or effect the formalities of completion acceptance.
监理人不能按时参加试车，应在试车前24小时以书面形式向承包人提出延期要求，但延期不能超过48小时，由此导致工期延误的，工期应予以顺延。监理人未能在前述期限内提出延期要求，又不参加试车的，视为认可试车记录。
Where the supervisor cannot participate in commissioning on time, should give 24 hours written notice to the contractor to postpone, however cannot exceed 48 hours of extension, if, resulting in delays of works, the working term will be extended correspondingly. Where the supervisor fails to provide requirement of postpone nor joining trial run, the trial record may be deemed as have been confirmed by the supervisor.
（2）具备无负荷联动试车条件，发包人组织试车，并在试车前48小时以书面形式通知承包人。通知中应载明试车内容、时间、地点和对承包人的要求，承包人按要求做好准备工作。试车合格，合同当事人在试车记录上签字。承包人无正当理由不参加试车的，视为认可试车记录。
The employer shall, upon satisfaction of single machine unloaded commissioning, organize a trial run, and give the contractor a 48 hours’ notice to the contractor with trial contents, time, place and the requirements to the contractor thereof. The contractor shall make the prepare subject to the requirement. Parties hereof will sign on the trial run record upon the qualification of trial. Where the contractor refuse to join in the trial without due ground, will be deemed as have confirmed the record.
试车中的责任Liabilities of Trial Run
因设计原因导致试车达不到验收要求，发包人应要求设计人修改设计，承包人按修改后的设计重新安装。发包人承担修改设计、拆除及重新安装的全部费用，工期相应顺延。因承包人原因导致试车达不到验收要求，承包人按监理人要求重新安装和试车，并承担重新安装和试车的费用，工期不予顺延。
Where the commissioning fails to satisfice the accept requirements due to design reason, the employer shall require designer to make modification of the design and the contractor will make re-installation subject to the amended design. The employer shall bear all the expenses for modification, design, dismantlement and re-installation thereof, and the time limit for the project shall be postponed accordingly. Where commissioning fails to meet the requirement of acceptance due to the contractor's reasons, the contractor shall as required by the supervisor make the re-installation and the trial, in addition to bear the cost of re-installation and trial run, and the construction period shall not be postponed.
因工程设备制造原因导致试车达不到验收要求的，由采购该工程设备的合同当事人负责重新购置或修理，承包人负责拆除和重新安装，由此增加的修理、重新购置、拆除及重新安装的费用及延误的工期由采购该工程设备的合同当事人承担。
Provided that the failure of trial run to the requirement of acceptance due to the manufacture of engineering equipment, the party which effecting the procurement of engineering equipment will be liable for re-procurement or repair, the contractor will be liable to make dismantlement and re-installation thereof, and the added costs with respect to the repair, re-procurement, dismantlement and re-installment in addition to the delayed time will be born by the party which effecting procurement thereof.
投料试车Commissioning Trial Run
如需进行投料试车的，发包人应在工程竣工验收后组织投料试车。发包人要求在工程竣工验收前进行或需要承包人配合时，应征得承包人同意，并在专用合同条款中约定有关事项。
Where it’s necessary to effect the commissioning trial run, the employer shall organize to do so subsequent to the completion acceptance. In case the employer require to do so prior to the acceptance or need the contractor’s cooperation, shall take the employer’s consent and stipulate the relevant matters in particular condition hereof.
投料试车合格的，费用由发包人承担；因承包人原因造成投料试车不合格的，承包人应按照发包人要求进行整改，由此产生的整改费用由承包人承担；非因承包人原因导致投料试车不合格的，如发包人要求承包
